§1 General Provisions
1.1. Fucita (hereinafter “Platform”) is an online marketplace enabling the sale and purchase of physical and digital products between users.
1.2. These Terms and Conditions (hereinafter “Terms”) govern the rules of using the Platform, including the rights and obligations of Sellers, Buyers, and the Platform.
1.3. By registering or using the Platform, you confirm that you have read, understood, and accept these Terms in full.
§2 Definitions
- Platform – the website operating under the domain fucita.com (currently fucita4896.live-website.com) and its subpages.
- Seller – a natural or legal person registered as a vendor on the Platform, offering products for sale.
- Buyer – a natural or legal person purchasing products via the Platform.
- Product – any physical or digital item offered for sale by a Seller.
- Commission – the fee charged by the Platform to the Seller for each completed transaction.
- KYC – Know Your Customer – the identity verification process.
§3 Registration and Account
3.1. Registration on the Platform is free of charge.
3.2. Each user may have only one account. Multiple accounts require prior written consent from the Platform.
3.3. The Platform reserves the right to verify user identity (KYC) at any time. Failure to provide required documents within 14 days may result in account suspension.
3.4. Sellers must provide true, current, and complete information during registration, including name, address, email, phone number, and tax identification (if applicable).
§4 Fees and Commissions
4.1. Commission for Sellers: 10% (ten percent) of each completed transaction value (excluding shipping costs). The Platform reserves the right to change the commission rate with 30 days’ notice.
4.2. Listing fees: Free – Sellers may list an unlimited number of products without upfront fees.
4.3. Payment processing fees: Covered by the Buyer – the Buyer pays all payment gateway fees (Stripe, PayPal, etc.) at checkout.
4.4. Withdrawal fees: Sellers pay a £0.50 fixed fee for each withdrawal request.
4.5. Additional services: The Platform may offer optional paid services (promoted listings, store upgrades, etc.). Prices will be clearly displayed before purchase.
§5 Selling Rules
5.1. Sellers may only list products that are legal, physically existing (or clearly marked as digital), and owned by the Seller or legally authorised for sale.
5.2. Prohibited items include but are not limited to: counterfeit goods, stolen property, weapons, drugs, hazardous materials, live animals, and any items violating UK or international law.
5.3. Sellers must accurately describe products, including condition (new, used, refurbished), defects, dimensions, and clear photographs.
5.4. Sellers must respond to Buyer inquiries within 48 hours and ship products within the time stated in their store policy (maximum 7 business days unless otherwise agreed).
§6 Shipping and Liability
6.1. The Platform does not handle shipping and is not a party to the shipping contract.
6.2. The Platform bears no liability for:
- Lost, damaged, delayed, or misdelivered parcels
- Carrier errors, theft, or damage during transit
- Incorrect addresses provided by the Buyer
- Customs fees, import duties, or taxes imposed by the destination country
6.3. The Seller is solely responsible for shipping products to the Buyer. The Seller must provide proof of shipment (tracking number) for every order.
6.4. The Buyer bears the risk of loss or damage from the moment the carrier takes possession of the parcel. Disputes regarding shipment must be resolved directly between Buyer, Seller, and the carrier.
§7 Penalty System – Progressive (No Lifetime Bans for Minor Violations)
7.1. General principle: The Platform operates a progressive penalty system. Lifetime bans are imposed ONLY for the most serious violations (fraud, illegal goods, identity theft). For other violations, the system applies warnings, temporary suspensions,

7.3. Definition of “violation”: Any breach of these Terms, including but not limited to: selling prohibited items, copyright infringement, misleading product descriptions, failure to ship, abusive behaviour toward other users, chargeback fraud, or attempting to bypass Platform rules.
7.4. Security deposits: The Platform may require a security deposit from users who have received two or more violations. The deposit amount is determined according to the table above. Deposits may be:
- Refundable – returned after a violation-free period (12 or 24 months) minus any administrative fees (£25)
- Non-refundable – forfeited to cover administrative costs, chargebacks, or damages caused by the user
7.5. Right of appeal: Every penalty may be appealed by contacting the administrator at legal@fucita.com. The appeal will be reviewed within 2 days. During the appeal process, the penalty remains in effect unless the administrator decides otherwise.
7.6. Lifetime bans are reserved for the most serious cases: financial fraud (chargebacks, fake payments), selling illegal or dangerous goods, identity theft, harassment causing harm to other users, or attempting to circumvent a permanent ban.
§8 Disputes and Refunds
8.1. Buyers and Sellers are encouraged to resolve disputes amicably.
8.2. If a resolution cannot be reached, the Platform may act as an intermediary but does not guarantee a decision.
8.3. Refund claims must be submitted within 14 days of delivery. The Seller must respond within 7 days. If the Seller fails to respond, the Platform may issue a full refund from the Seller’s pending balance.
8.4. The Platform reserves the right to deduct funds from a Seller’s account to cover refunds, chargebacks, or damages caused by the Seller.
§9 Data Protection
9.1. The Platform processes personal data in accordance with UK GDPR and applicable laws.
9.2. By registering, users consent to the collection and processing of their data for the purpose of providing Platform services.
9.3. Users have the right to access, rectify, or delete their personal data by contacting privacy@fucita.com.
§10 Prohibited Content and Activities
10.1. Users may not post content that is: defamatory, obscene, hateful, discriminatory, threatening, or infringing on intellectual property rights.
10.2. The Platform reserves the right to remove any content that violates these Terms without prior notice.
§11 Amendments to Terms
11.1. The Platform may amend these Terms at any time. Registered users will be notified by email at least 14 days before changes take effect.
11.2. Continued use of the Platform after the effective date constitutes acceptance of the amended Terms.
§12 Governing Law and Dispute Resolution
12.1. These Terms are governed by the laws of England and Wales.
12.2. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to the courts of England and Wales.
